Terms of Service

These Terms of Service ("Terms") govern your use of K3SD software and services provided by Jensen & Miles SARL, a company registered in Luxembourg ("Company", "we", "us").

1. Service Tiers

Community (Free) — The K3SD Community edition is provided free of charge under the Business Source License (BSL 1.1). See the License page for details.

Pro (Subscription) — A monthly subscription at the published rate, granting access to Pro features for a single organization. Payment is due monthly in advance. You may cancel at any time; access continues until the end of the paid period.

Enterprise (Annual License) — A custom annual license agreement negotiated individually. Enterprise licenses include dedicated support, SLA, and deployment assistance. Contact sales@jensenmiles.lu for details.

2. License Keys

Pro and Enterprise license keys are issued to a specific organization and are non-transferable. Each key authorizes deployment on the number of clusters specified in your agreement. Sharing license keys outside your organization constitutes a breach of these Terms.

3. Payment & Billing

Pro subscriptions are billed monthly. Prices are in EUR and exclude applicable taxes.
Enterprise licenses are billed annually as per the signed agreement.
We reserve the right to adjust pricing with 30 days' written notice.
Overdue payments may result in license deactivation after a 14-day grace period.

4. Support

Community: Community support only (GitHub issues, documentation).
Pro: Email support with a target response time of 2 business days.
Enterprise: Dedicated support channel with SLA as defined in your agreement.

5. Data & Privacy

K3SD runs entirely within your infrastructure. We do not access, store, or process your cluster data. See our Privacy Policy for details on analytics and telemetry.

6. Availability & Warranty

K3SD is provided "as is" without warranty of any kind, express or implied. We do not guarantee uninterrupted or error-free operation. Enterprise customers receive availability commitments as defined in their SLA.

7. Limitation of Liability

To the maximum extent permitted by Luxembourg law, Jensen & Miles SARL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of K3SD.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may stop using K3SD at any time.
We may terminate or suspend your license for breach of these Terms, with 14 days' notice for curable breaches.
Upon termination, your license key will be deactivated. Your data remains in your cluster and is unaffected.

9. Governing Law

These Terms are governed by the laws of the Grand Duchy of Luxembourg. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Luxembourg City.

10. Changes

We may update these Terms from time to time. Material changes will be communicated via email (for paying customers) or posted on this page. Continued use after changes constitutes acceptance.
